Covenants, Conditions & Restrictions (CC&R’s)
As homeowners and residents in the Barrington of Rockledge community, you are bound by the Covenants, Conditions, and Restrictions (CC&R’s) described in our governing documents.
Covenants, conditions, and restrictions (CC&Rs) are created to promote and preserve the symmetry, beauty, and general good of all property owners in our neighborhood. It is generally thought that communities that enforce their covenants tend to be safer, look better, and maintain or increase the investments that owners have made in their properties.
It is the duty of the Board of Directors to uphold the CC&R’s.
Residents are encouraged to read the full Covenants, Conditions, and Restrictions to reduce the opportunity for violation notices. Should a home fall behind on compliance the board will send a friendly reminder to help the homeowner get back up to speed.
The Notification Process:
The Board is obligated, in the best interest of the entire neighborhood, to fairly and consistently enforce the rules of the Covenants, Conditions, and Restrictions. To ensure proper “notice and opportunity to cure” has been given, the following steps have been established for covenant violations:
Friendly Reminder — Many CC&R violations are unintentional. For those residents who may not be aware, or have failed to recognize a growing covenant issue over time, a courtesy reminder is mailed to homeowners asking that the issue be resolved within a two week period (most violations).
Violation Letter — This is a formal notice of a violation. Following the courtesy reminder, homeowners who fail to correct a documented issue will be mailed this violation letter. These notices provide an opportunity to correct the issue or provide a plan of action for resolving the issue.
2nd Violation Notice — Homeowners failing to make contact regarding the initial violation notice are given a final opportunity to address the covenant violations for property within the community. Homeowners are again given an opportunity to correct the violation or provide a plan of action to resolve the issue.
Board Review — Homeowners who refuse to comply with the Association’s requests to cure a violation will receive a final letter indicating that the violation will be turned over to the Barrington of Rockledge Board of Directors for further measures, up to and including legal action.
Please keep in mind that each notice mailed to owners creates additional expense to the Association which affects our annual assessments. Please do your part to keep our neighborhood looking great and our Association costs in-line!
